The sheer number of expats playing o/s proves it in my mind. I've seen the situation in europe, i know the ropes and am certain its been applied, generously and often. There's a reason clauses are made dumbo. If they had no need for expats to be allowed to play, this clause simply wouldnt be in the rules now would it TLPG?

What you say there is not proof. It is assumption - and I don't believe you with regards to experience anyway.
You have to provide bona fide and verifiable evidence. Until then - the rule has not been used. Just because some ex-pats may play in the local competition is a long straw for you to draw and it doesn't work. Of course they'll play for the local comp. They just can't play in the International Cup, and rightly so.

In my opinion. The onus of proof is on the person trying to prove something (ie that the rules has been applied). It is almost impossible to prove that a rule has not been applied, even if this is the case.

The rule itself has been made for a reason, all rules are. To say it has "never been applied" is ridiculous. In this case it's similar to saying the head hig tackle rule has never been applied.
We must understand a few things:
1. In my experience playing and talking with marngrook players o/s the number of expats playing in the comps was above 80%, and many of these had been living o/s for years.
2. I've seen this rule applied in cricket for the Irish and Netherlands teams.
3. What Aussie wouldnt want to try his hand at making the national side (I did!) and then coming to play in melb in the cup?
4. The level of ability amongst the local players was generally well under that of the Aussie expats playing, well under.
I dont need to provide proof. Common sense saves me the time.
And the old impossible to prove if this has not been applied is garbage. There would be paper work involved if someone had applied. If noone has there would be no paperwork i.e. no record and therefore clear evidence that the rule has not needed to be applied.
